国务院关于废止第二批涉外法规的通知(附英文)
国务院



为了加快实施沿海地区经济发展战略，促进我国沿海地区外向型经济的发展，国务院有关部门根据国务院关于清理涉外法规的部署和要求，对国务院发布或者批准发布的现行涉外方面的行政法规和法规性文件（以下简称法规）进行了清理。清理出来的第二批应予废止的法规12件，经
国务院清理涉外法规领导小组和国务院法制局逐件复查，国务院审议，决定予以废止（法规名称见附件一）。
同时清理出来的第二批自行失效的法规16件，也经国务院清理涉外法规领导小组和国务院法制局逐件复查，现一并附后（法规名称见附件二），以便各地区、各部门全面了解已失效的涉外法规的情况，利于工作。

CIRCULAR OF THE STATE COUNCIL CONCERNING THE ANNULMENT OF THE
SECOND BATCH OF REGULATIONS GOVERNING FOREIGN-RELATED MATTERS
(September 27, 1988)
In order to speed up the implementation of the strategy for economic
development in the coastal areas, and to promote the development of
export-oriented economy in the coastal areas of our country, the
departments concerned under the State Council, in accordance with the
planning and requirements of the State Council for the sorting out of
regulations governing foreign-related matters, have undertaken the sorting
out of the existing administrative regulations as well as other legal
documents (hereinafter referred to as "the regulations", for short),
promulgated by the State Council or promulgated with the approval of the
State Council. At present, the second batch of twelve regulations, which
have been sorted out and should be annulled, have been re-examined, piece
by piece, by the Leading Group under the State Council for the Sorting Out
of Regulations jointly with the Bureau of Legislative Affairs of the State
Council and by the State Council: and it is decided to announce the
annulment of the aforesaid regulations (See Annex I for the titles of the
aforesaid regulations). At the same time, the second batch of sixteen
regulations, which have become invalid automatically, have also been
sorted out and reexamined, piece by piece, by the Leading Group under the
State Council for the Sorting Out of Regulations jointly with the Bureau
of Legislative Affairs of the State Council: and now these sixteen invalid
regulations (See Annex II for their titles) are also included here as
Annex II in order to help various regions and departments concerned obtain
an overall understanding of the condition of those invalid regulations
Governing foreign-related matters, thereby facilitating their work.

全国救灾扶贫经济实体管理暂行办法

1989年12月29日，民政部

第一条 为了办好救灾扶贫经济实体（包括救灾扶贫福利企业，以下简称经济实体），促进农村救灾扶贫事业的发展，制定本办法。
第二条 经济实体是在民政部门扶持下，以灾民、贫困户为主体、有部分残疾人和优抚对象参加的从事自救性生产和经营的社会福利性质的经济组织。
第三条 经济实体除具备一般经济组织的条件外，还必须具有如下特征：
（一）以生产自救为主要目的；
（二）以灾民和贫困户为主体；
（三）由民政部门领导。
第四条 经济实体由民政部门归口管理，根据所有权、管理权和经营权的不同情况，进行方针政策指导、宏观调控和监督。
第五条 举办经济实体要本着国家扶持和动员社会力量相结合的原则，多渠道筹集资金。
第六条 经济实体要遵守国家的法律、法规，贯彻有关方针政策，实行民主管理，文明经营。
第七条 经济实体要努力提高经济效益和社会效益，扶持灾民、贫困户摆脱贫困。
第八条 经济实体的立项、资金投放必须经救灾扶贫周转金管理委员会（以下简称周转金管委会）审批，签订经济合同。
第九条 举办经济实体要立足本地资源，发挥本地优势，选择投资少、见效快、效益高的生产经营项目。
第十条 经济实体实行独立核算、自主经营、自负盈亏。
（一）实行厂长（经理）负责制，厂长（经理）是法人代表。
（二）推行以承包为主要形式的经营责任制。指标要先进合理，公开招标，并进行公证。
（三）实行岗位责任制，根据按劳分配的原则，制定工资制度。
（四）建立健全质量，物资、产品、劳动和财务管理等制度。
（五）编制切实可行的生产经营计划，建立正常的生产经营秩序，坚持经济核算和经济分析，不断提高生产经营水平，并根据条件挖潜、革新、改造，积极促进技术进步，提高企业素质。
（六）建立公积金、公益金和奖励基金制度。
第十一条 经济实体的利润分配，要兼顾国家、集体、个人利益。留成的利润主要用于发展生产；按规定上交的费用，纳入救灾扶贫周转金。继续用于救灾扶贫事业。
第十二条 任何单位和个人不得以任何形式向经济实体摊派资金、物资和劳务。
第十三条 有一定数量经济实体的县和县以上的地方，可以成立救灾扶贫服务公司（包括中心、站）并逐步过渡为企业公司（以下简称公司）。公司的职能和主要任务是：
（一）受救灾扶贫周转金管委会的委托，举办经济实体、联合体和进行单户扶持；
（二）为经济实体、联合体和扶持户提供技术、信息、培训、供销和经营管理等方面服务。
（三）运用经济手段，对救灾扶贫经济活动进行引导、管理和监督；
（四）适当开展自营业务；
公司对同级民政部门和周转金管委会负责，贯彻有关救灾扶贫的方针政策，报告生产经营和资金运用情况。公司的费用按规定从有偿服务、自营业务收入和管理费中开支。
第十四条 适合残疾人工作的经济实体，应吸收残疾人务工达到一定比例的，要办成救灾扶贫福利企业。
第十五条 经济实体定期向公司编报经济活动和效益情况统计表，公司汇总向同级民政部门和周转金管委会编报。
第十六条 本办法由各级民政部门组织实施。
第十七条 各地可根据本办法制定本地区的管理办法或实施细则。
第十八条 本办法由民政部负责解释。
